Judging by the dark color of the stem I’d say peppermint. You could either wait a bit longer before potting or make sure to keep the soil rather moist for the next days.
Usually you want to wait until the roots have roots, until they’re branching pretty decently. Just make sure you keep the soil moist whenever you transfer to soil, for at least a week. You need to give the roots time to acclimate to soil. Then you slowly let it dry out until it’s preferred dryness level before watering it normally.
From the mere pics only the light can trick you and make wrong assumptions. What does it smell like? What does it taste like?
You should remove the bottom 8 leaves so that the mint has less chance to get shocked by going into soil.
